The CLARITY Act, crypto’s biggest shot at U.S. regulatory clarity, is stuck in gridlock. Here’s what’s holding it up — and what it means for investors.
Let me tell you where I’ve quietly landed on all this, because it might surprise you: I think they get it done this year.
Right now, the CLARITY Act — Washington’s big attempt to finally draw sensible lines around crypto — is stuck in the kind of gridlock only Congress can manufacture. Nearly 100 Catholic leaders are opposing it over anti-trafficking loopholes. JPMorgan is asking for stronger safeguards. The White House is huddling with law enforcement to smooth it over before the summer break. And in a separate twist, the Senate passed a bill banning a retail Fed digital currency through 2030 — only for the President to refuse to sign it, over something completely unrelated.
Messy, isn’t it? But step back with me for a second, because I think most of that is noise, and underneath it, the signal is one clear way.
Who’s actually against it — and why it’s less alarming than it looks
The opposition isn’t one angry mob. It’s a few groups, each wanting different things:
- The coalition of Catholic leaders says a provision would weaken safeguards against human trafficking and financial crime.
- JPMorgan isn’t against the bill at all — it just wants regulatory clarity paired with stronger guardrails.
Here’s what I notice, though. Nobody in that list is saying “crypto shouldn’t be regulated.” They’re arguing about how, not whether. And that’s a very different — and far more hopeful — conversation than the one we were having a few years ago, when the question was whether crypto deserved a seat at the table at all.
The noise that makes it look worse than it is
CBDC bill getting held up over an unrelated fight? That’s Washington being Washington — bundling, trading, using one thing as leverage for another. It looks like chaos. Really, it’s just the ordinary, grinding mess of how anything gets done there.
Don’t let that mess convince you that nothing is happening. The direction of travel matters more than the potholes along the way — and the direction here is toward crypto being treated as real, regulated, permanent financial infrastructure.
Why I’m quietly optimistic
I won’t pretend to know the exact date. But here’s why I lean hopeful: the disagreements left are about details, not principle. Both parties have publicly committed to getting it done. The industry has grown too big and too woven into the system to be left unregulated forever. When the argument shifts from “should this exist?” to “let’s get the wording right,” you’re usually closer to the finish line than the noise suggests.
So my honest read? I think it lands this year. And even if it slips, it’s coming — the arc only bends one way.
But here’s the part that actually matters for you
Whether it passes in July or next spring, please don’t do the thing I watch so many people do: waiting for clarity before they’ll do anything at all. And waiting, and waiting.
Regulatory fog has been the near-constant backdrop of crypto since 2017. Through every “the rules are coming soon,” the market still ran its cycles. If you’d sat on your hands until the sky cleared, you’d still be sitting there today. So I don’t build a strategy that depends on the rules being resolved — I build one that works either way, and lets me play the long game with a calm head.
The real takeaway
Regulation isn’t a threat to crypto’s future. It’s the sign that it’s growing up. The messy hearings and stalled votes you’re reading about aren’t the end of the story — they’re the awkward, necessary middle of it.
Zoom out. Stop watching the weekly weather and start watching the season. The long game here favours the patient and the prepared — and I’d love for that to be you.
Policy moves markets long before it ever becomes law. The Intelligence Brief tracks the regulatory signals that actually matter — so you’re positioned before the vote, not scrambling after it.
Not financial advice — just how I stay calm and quietly hopeful while Washington makes up its mind.
